RESUMEN: Hay un proceso de evolución, desde la primitiva regulación de la propiedad por pisos del Código Civil hasta la vigente Ley de Propiedad Horizontal, que se manifiesta especialmente en el régimen de aprobación de acuerdos, un proceso que ha sido paralelo a la evolución social y económica de la sociedad, y al estado de la técnica. El resultado ha sido la progresiva limitación de la exigencia de unanimidad para facilitar la adopción de acuerdos en materias como accesibilidad, ahorro, diversificación y eficiencia energética, telecomunicaciones, contaminación, que en muchos casos obedecen a intereses que exceden de los particulares de los propietarios, individual o colectivamente considerados. De esa tendencia legislativa, expresada en sucesivas reformas de la Ley, se ha querido extraer un principio general contrario a la unanimidad, que no solo excedería de los objetivos de dichas reformas, sino que estaría en contradicción con algunos de ellos, especialmente en materia de mejoras o innovaciones no exigibles. El problema ya se está planteando, y de la solución, todavía pendiente, pueden depender los derechos, la economía, la supervivencia de muchos propietarios en su comunidad, y la misma convivencia social.

 

ABSTRAC: There is a process of evolution, from the primitive regulation of property by floors of the Civil Code to the current Law of Horizontal Property, which is manifested especially in the regime for the approval of agreements, a process that has been parallel to the evolution, social and economic, of the society, and the state of the science. The result has been the progressive limitation of the requirement of unanimity to facilitate the adoption of agreements in areas such as accessibility, savings, diversification and energy efficiency, telecommunications, pollution, which in many cases obey interests that exceed the owners’ particular interests, individually or collectively considered. From this legislative tendency, expressed in successive amendments to the Law, it has been sought to extract a general principle contrary to unanimity, which would not only exceed the objectives of said reforms, but would be in contradiction with some of them, especially with regard to no required improvements or innovations. The problem is already being raised, and the solution, still pending, may depend on the rights, the economy, the survival of many owners in their community, and the same social coexistence.
